Gurugram. In two separate cases of affordable housing, the Haryana Real Estate Regulatory Authority (HERERA) has ordered the builder to pay Rs 10,000 on the amount paid by the buyers for not handing over the houses to the buyers within the stipulated time. Pay 75% monthly interest.
Along with this, the court has ordered that the fee charged for other items in the Affordable Housing Project cannot be charged.
On behalf of the home buyers, advocate Jagdeep Kumar said that Aruna Sharma had booked a one BHK flat in the Affordable Housing Project located in Sector-104. Rohit Sharma had also booked a 2 BHK flat in the same project. This project of JMK Holdings Private Limited started in the year 2016. The builder was supposed to make the flat by the year 2020 but even after the stipulated time, the builder could not give the flat.
Aruna Sharma Total cost of her flat 14. Out of Rs 50 lakh, Rs 13 lakh has been given to the builder. Rohit Sharma had booked his flat for Rs 23 lakh. He has also given more than 80 percent amount to the builder. The buyers approached HARERA in 2021 for not getting the flats on time. Advocate Jagdeep Kumar told that the builder has not given the property within the time limit and also talked about putting pressure to recover the money in other items.
After hearing the matter, the court ordered the builder to pay 10.75 per cent interest per month on the amount paid by the buyer so far. Jagdeep Kumar says that the court should take suo moto cognizance of the arbitrariness happening in the cases of affordable housing and the builder wrongly charging money for other items.
