Good news for public prosecutors, LG approves revised pay scale

Delhi Lieutenant Governor Vinay Saxena on Monday gave his consent to the revised pay scale of Assistant Public Prosecutors (APP) under the Directorate of Prosecution GNCTD. After getting the approval of LG, the old and big demand of public prosecutors has been fulfilled. Now GNCTD prosecutors will get the benefit of increased pay scale from September 3, 2015.

According to Raj Niwas officials, LG Vinay Saxena approved the proposal to grant higher revised pay scale of Pay Band 3 with grade pay of Rs 5,400 to Assistant Public Prosecutors (APPs) working under the Directorate of Prosecution GNCTD. Now they will also get all the consequential benefits from 3rd September 2015. Officials said the existing pay scale for APP is in Pay Band 2 with grade pay of Rs 4,800 and the proposal to revise it was put forward by the Home Department in consultation with the Finance Department, GNCTD after examining the matter in the revised APP. Agreed with the proposal to implement the pay scale.

Public Prosecutor was demanding for a long time

The revision in pay scales for APPs took place after lengthy litigation in the Delhi High Court involving the Delhi government and others and correspondence with the Union Home Ministry and the LG Secretariat. Officials said the issue of revised pay scales for APPs had started in the Delhi High Court in a writ petition titled Court on Its Own Motion vs State, involving various issues affecting the prosecution.

Delhi, i.e., the salary structure of the prosecutors of the Directorate of Prosecutions, the infrastructure of the DOP, the fees and professional fees of the permanent lawyers and the lawyers being appointed by the State were considered.

LG had raised this issue with MHA

Officials of the Prosecution Directorate said that the High Court, in its order dated September 3, 2015, directed the Delhi Government to ensure necessary compliance with respect to the implementation of the decision of the Union Cabinet dated September 1, 2015, approving the amendment in the pay structure of the Prosecution Officer of the Directorate of Prosecutions.

And instructions were given to submit the report. Now the LG Secretariat took up the matter with the Union Home Ministry through a letter dated 29 December 2015 and meanwhile the Delhi Prosecutors Welfare Association (Registered) had filed a contempt before the High Court, which was dismissed by the Court on 3 September 2015. Instructions were given to follow the instructions.
