The insurance company will give Rs 28 lakh to the consumer for a 12-wheeler truck stolen from in front of a hotel in village Sidhrawali about three and a half years ago. The insurance company will have to pay this amount at an interest rate of nine percent. Apart from this, the company will also have to pay two lakh rupees to the victim for mental stress and Rs 22 thousand as legal expenses. This order has been given by Sanjeev Jindal, Chairman of Consumer Disputes Redressal Commission.
The truck owner was being given less money by the insurance company. Angry with this, the victim Billu Ram, a resident of village Nangal Mehta in Alwar district of Rajasthan, had filed a petition in the Consumer Commission. Billu Ram had insured his truck from The New India Assurance by paying Rs 69.5 thousand on the vehicle price of about Rs 28 lakh from 17 September 2020 to 16 September 2021.
Truck driver Shailesh Kumar was going from Kotputli in Rajasthan to Pali in Faridabad on 29 January 2021 with stones loaded in the truck.
The driver stopped the truck at a hotel in Sidhrawali village to have tea at 2 am. When the driver came out after drinking tea, he saw that the truck had been stolen. Bilaspur police station has registered a case on the complaint of the truck owner.
After filing a complaint of truck theft to the insurance company, the truck owner gave the documents to the company to get the claim from the insurance company. The insurance company was giving a total of Rs 25.63 lakh to the consumer of the stolen truck. Whereas according to the insurance, the price of the truck was about Rs 28 lakh.
Truck owner Billu Ram had filed a petition in the consumer commission and asked for about Rs 28 lakh with interest rate. After listening to both the parties, the commission accepted that the price of the truck at the time of insurance was Rs 28 lakh.
Therefore, the insurance company will give about Rs 28 lakh to the consumer at an interest rate of nine percent. Apart from this, compensation for mental stress and legal expenses will also have to be paid.
